Terms of Use for Monei

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User" or "you") and Alessio Rubicini ("Developer," "we," "us," or "our") concerning your access to and use of the Monei mobile application (the "App").

By downloading, installing, or using the App, you agree that you have read, understood, and agree to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE APP AND YOU MUST DISCONTINUE USE IMMEDIATELY.

1. The App and License Grant

A. Description of Service

Monei is a personal finance tracking application designed to help Users record and manage their expenses, incomes, and transfers. The App is provided exclusively on an offline, local-storage basis. No external accounts, servers, or cloud services are required or used for core functionality.

B. Limited License

Subject to your compliance with these Terms, the Developer grants you a personal, non-exclusive, non-transferable, revocable, limited license to install and use the App on a single device that you own or control, and to run the App solely for your personal, non-commercial use.

C. Restrictions

You agree not to, and you will not permit others to:

1. License, sell, rent, lease, assign, distribute, or otherwise commercially exploit the App.
2. Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
3. Use the App for any illegal or unauthorized purpose.
4. Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of the Developer or its affiliates, partners, suppliers, or the licensors of the App.

2. Intellectual Property Rights

The Developer retains all right, title, and interest in and to the App, including all copyrights, trademarks, patents, and other intellectual property rights. The Monei name, logo, and all related names, trademarks, and service marks are the property of the Developer. Your use of the App does not grant you ownership of any content, code, data, or materials you may access on or through the App.

3. User Data and Local Storage

A. Data Ownership and Responsibility

All financial data, account details, notes, and other information you enter into the App ("User Data") is stored locally and exclusively on your personal device using the secure storage capabilities of the iOS operating system.

B. Developer's Access

The Developer does not collect, receive, store, or have access to your User Data. Because the App operates offline without transmitting data to us, you are solely responsible for the security and backup of your User Data.

C. Data Loss

The Developer is not responsible for any data loss resulting from device malfunction, device replacement, operating system updates, accidental deletion of the App, or failure to perform backups (e.g., via iCloud or other methods you initiate).

4. App Store Terms

You acknowledge and agree that the availability of the App is dependent on the third party from which you received the App license, e.g., the Apple App Store. You acknowledge that these Terms are between you and the Developer, and not with the App Store. The App Store is not responsible for the App or the content thereof. You must comply with the App Store's terms of service, which are incorporated herein by reference.

5. Disclaimers and Limitations of Liability

A. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. You agree that your use of the App will be at your sole risk. To the fullest extent permitted by law, the Developer disclaims all warranties, express or implied, in connection with the App and your use thereof, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranties or representations about the accuracy or completeness of the App's content.

B. Limitation of Liability

In no event will the Developer or any individual associated with the Developer be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the App, even if the Developer has been advised of the possibility of such damages.

6. Term and Termination

These Terms shall remain in full force and effect while you use the App. You may terminate your agreement with the Developer by deleting the App from your device. The Developer may terminate these Terms and your access to the App at any time, without notice, if we believe you have breached these Terms. Upon termination, the license granted to you will immediately cease.

7. Governing Law

These Terms of Use and your use of the App are governed by and construed in accordance with the laws of Italy, applicable to agreements made and to be entirely performed within Italy, without regard to its conflict of law principles.

8. Miscellaneous

These Terms of Use and any policies posted by us on the App or in respect to the App constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision.
